Surplus lines export law just became friendlier
What seemed murky is now clear: agents can export commercial residential policies to the non-admitted market when seeking to procure coverage not offered by their appointed, admitted markets. This guidance comes from the Department of Financial Services in the form of written answers to questions posed by your association (read the Q&A in Laura’s Legal Brief of the Week).

The DFS also clarified that only one declination is required for residential or commercial residential structures with a replacement cost greater than $1 million. Read Jeff Grady's blog for information about how FAIA is seeking a legislative repeal of the diligent effort.
