Citizens to require premium indications for 2017 takeouts
Great news for policyholders and agents out of this week’s Citizens Depopulation Committee meeting: Big improvements are pending for the takeout process, including the ability for agents to register the policyholder’s selection in the Citizens system, and just one letter (that includes premium indications) from Citizens to policyholders with offers instead of separate letters from each carrier. OIR responds to NCCI’s workers’ compensation rate request
Workers’ compensation rates are going up, but not by 19.6 percent as requested by the National Council of Compensation Insurance (NCCI). After a lengthy review, the Florida Office of Insurance Regulation denied the NCCI’s request this week and instead issued an order giving contingent approval to an overall combined average increase of 14.5 percent statewide. IIABA sues to halt DOL overtime rule
The Big “I” is the only insurance industry group to join a lawsuit against the U.S. Department of Labor that seeks to reverse the agency’s burdensome overtime rule set to take effect December 1, 2016. Read more.

Just say no to lender requests
Add “requests for litigation information” to the list of unreasonable lender requests. David Thompson offers advice for handling this and other lender demands in his latest blog.
Beware ‘entrustment’ exclusion
If you have customers who lease their commercial property, you may want to review their property insurance coverage cause of loss form to see if it contains an “entrustment” exclusion. Why? Because a recent court ruling concluded, in effect, that leasing property is the same as “entrusting” it to the tenant, which means the exclusion could preclude coverage for a loss. Read more.

Daniel James Nichols
We extend our thoughts and condolences to the family, friends, and colleagues of Daniel Nichols, who passed away September 10.
